A Smithsburg man was convicted and sentenced Wednesday morning to serve 10 years in prison, with all but 18 months suspended, for sexually assaulting a 10-year-old boy. 

Ryan Magoun, 20, pleaded guilty to a third-degree sex offense. 

According to court documents, the victim told his mother that Magoun touched him inappropriately in June 2017, when Magoun was 18. The victim’s mother said in court documents, “Ryan grabbed [the victim’s] hand and placed [the victim’s] hand in Ryan’s pants.” Court documents further state, Magoun put his mouth on the boy’s private area and “Used his private in the back of me.” 

When asked how many times Magoun touched him, the boy stated: “Probably two or three more times.” 

Lab results from the Maryland State Police, Forensic Sciences Division located Magoun’s DNA on the child’s genitalia swabs, scrotum swabs and swabs from inside of the front area of the child’s underwear. 

According to court documents, the boy and Magoun were neighbors. Magoun would invite the victim over to his house to play video games. 

Court officials say Magoun’s sentence of 10 years includes no contact with the victim or the victim’s family, as well as no unsupervised contact with children.
